    We are trying to reorganize as suggested by MARA.

    Working toward the same goals as outlined by DEP, local DEP certified contractor and a home property service, that visited the road, would seem logical.  However, several long residents and now members of the association decided they know better. The result is a mess. One on one discussion results in an agreement that is later broken.

    Any suggestion?

    I have read some of your past postings. Your association is fortunate to have you working to improve involvement of fellow owners in road maintenance. 

    Since you are organized as a Statutory Road Association, take a deep breath, call a meeting, follow an agenda, listen, vent, and vote the majority for proposed actions or dissolution of the association.

    Democratic process is messy. Each day reveals both strength and fragility. You may have to be patient, wait for things to get bad enough to bring people together to fix the mess.

    Yes, Patience in an impatient  world.

    Trying to use email to reach everyone for discussion and then voting.

    Hope this works. Realy no other choice.

    I don't mean to be a bug in the ointment but...

    If you want to call a meeting according to the Statutes so that your votes will be seen as records that will hold up in court, you will need each owner's (written) permission to use email for official notifications. See 23 M R S §3101(3).

    Without email permission, notification of the meeting, including proposed budget and agenda, must be sent to all owners 30 days prior to the date of the meeting by U S Mail at the owner addresses in the Town Assessor's Office. If this is done, you can make binding decisions with a majority of those present and voting or absent and voting by proxy or absentee ballot.  See §3101(2) and (4) for details.

    Appreciate your concern.

    We are following line by line title 23 private ways section as suggested by MARA. 

    Starting over will take time to get it right this time.
