Harassment of Board Members

    Hello;

    I am the current President of our road association. 

    We have 14 lot owners and one or two constantly harass us with nothing but petty things and some times actually have accused the board of nefarious/criminal doings as well.  Our By-Laws do not address this situation. 

    My question: Are there any legal avenues that we can take as the board to somehow censure them or make them stop with the harassment.

    I appreciate this topic as I have struggled with this. I have had death threats, members bringing their guns, attack dogs and other disgusting behaviors. The extent of mistrust especially between neighbors is very intense. We have our finances audited annually to prevent members from accusing board members of pocketing the money. What makes it even more difficult is the lack of privacy.  We end up knowing about our neighbors very personal and private affairs in regards to paying dues and assurance that the roads are maintained due to medical issues. As a result of knowing about people's personal information, a great paranoia or fear occurs. Will privacy and confidentiality be respected? Gossip in a neighborhood is messy. The bottom line for issues of safety, is obtaining a protection from harassment court order. A  challenge comes up though, how do you conduct officer or board member duties if you have a protection order?

    Mediation is helpful and we are fortunate to have a police officer on our board. Also what has been successful for us is having new people on our board. A new board member is more likely to be welcomed by the disgruntled  neighbor/member. If you want legal help then consult an attorney.

    I am not an attorney, but in my experience, getting a cease harassment order is not a difficult process.

    Your info is extremely valuable to us as board members.

    Fortunately, the complaining members have been quiet of late....I'm hoping that we don't have to go the litigation route!! Maybe they know we have legal options. I'll keep my fingers crossed that things stay quiet in our neighborhood.
