Two Statutory Road Assoc. on same road same road

    We have a road served by two groups, group 1 made up of lots that have been in families for years, group 2 made up of lots made by developers. Group 1 at the beginning of road maintained by lot owners ad hoc operated  that way for over 50 years. Group 2 recent last 37 years as a Non-profit corporation. Difficulties arose over Group 2 telling group 1 what work had to be done on the road and how much group1 had to contribute to  that section of road that group1 lots fall on. Group 1 has no voting rights to the non-profit road association but always paid their share of costs on the share of roads. Efforts have been made to find a solution that serves both parties but to no avail. Group1 has decided to form a Statutory Road Association that will allow them to control and bill group2 for the maintenance of  group1 portion of road. Thoughts on this arrangement and possible problems?

    I suggest you negotiate with the other road association and form one statutory RA for the road. If that is not possible, then the association that wants to go statutory would need to send notice of a an organizational meeting to all owners along the road, including those in the “2nd” road association, and let a majority vote decide the outcome. If statutory RA approved, future maintenance would be decided by a majority vote of all owners along the road.

    Where there is already friction, having one group compel the other group to join a statutory road association may not go smoothly.  This is a case where a professional Mediator could be a big help in getting people to listen to each other calmly and find common ground.  Leah Boyd of Clarity Services, who has done workshops for MARA conferences, specializes in group mediations.  I would strongly recommend you see if you can get her to help you work through this.  It would be money well spent, and could help things get off to a smooth start rather than having tempers flare and then having to undo the damage later.  If need be, I'd be willing to also attend, schedule permitting, (perhaps via Zoom,) to lend my expertise on how to go about forming a statutory road association.  (No charge.)  Having all parties understand the process can also help it go more smoothly.
