Association Vote on who can use the road

    Our by laws say if you live on road x and y as laid out in the original subdivision map, you are a member of the Association. (They should probably say if your deed says you have access, you are a member - right?) Can a non profit road association vote to add (new) roads "A and B" to the Association when there is nothing in the deed that gives access? Thank you for your non legal opinion.

    My non legal thought is that if you are also a statutory road association, "mandatory" membership is limited to properties that benefit from the road(s), which generally means deeded access. If it can be argued that these properties benefit legally, I would think they could be included, otherwise, membership of owners on these roads would likely be optional or voluntary. I don't know how non statutory associations bind their members. Before we became a statutory association, less than a third chose to pay.
