Benefits of Registering your Association or bylaws (if that is a difference)

    I searched the MARA forum for this topic and it was last discussed in 2012 and 2014.  Is anyone in a RA that registered?  What influenced that decision and how has it been useful?  I also searched Cumberland County deeds for "road association" and it only turned up crickets :). I spoke with my local registrar and we agreed that a title abstractor would not necessarily know to look for "Lazy Acres Road Association" or that it includes property on "1029 Four wheel Drive" if Lazy Acres was registered.

    This may be semantics, but when a document is placed in the County Registry its contents are recorded, not registered. There is no "Registry" or official means to track the status of Maine's many Private Road Maintenance Associations (RAs) at this time. 

    RA members may, however, record their entity in the Registry of Deeds to possible advantage. Mortgage lenders seem to like and may require the promise of strong, stable road maintenance for homes they finance. This reason for recording an RA may be foremost in comments that appear in a Discussion Forum Post in which I question Attorney Mary Denison regarding her handout for the 2020 MARA Road Conference entitled, "Registry Notice of Statutory Road Association".

    To find Attorney Denison's comments in our Discussion Forum on the above topic, use our search engine and insert, "Clarification Denison". Our Post will appear.

    Our Statutory Road Association decided to record a Registry Notice in 2021. Our By-laws are also recorded, providing additional information about our neighborhood to potential buyers and lenders. I do not believe recording in the Registry is limited to Statutory Road Associations.
