We have a disgruntled member of our association that insists he owns all the roads. He refuses to pay his assessments even though he allows the association to make improvements to "his roads". He further insists that all projects be approved by him prior to commencement. Does anybody know how the law views this type of situation. It is our opinion that we don't need his permission to improve and maintain
our
roads.

Does he, in fact, own the roads? And do the rest of the parcels have easements for the use of the roads?

As far as we know the residents own to the center line of the road and we all have easements to pass over the roads.

if you stop fixing "his" road's he would rethink just who's road's they are pretty quick.
