Does anyone know if Section 3102 of the Statutory Law actually limits the total annual assessment of an individual? The wording says "The commissioner's or board's apportioning of the cost of repairs to the road undertaken pursuant to the provisions of section 3101 may not exceed 1% of an individual owner's municipal property valuation in any calendar year."
I was hoping it literally relates just to road repair costs, not plowing or liability insurance premiums. For our small potential road association, winter plowing/sanding costs almost max out a 1% limit, let alone do any actual "repairs" to the road.
Also, I assume the "owner's property value" refers to the town assessed value of the actual lot(s) involved in the association--not other property he/she might own elsewhere.
