Our town ordinance does not have any guidelines for fixing an illegal subdivision "after the fact". Does anyone out there know of any laws, procedures, steps that must be taken to correct this situation? We are being told that the 3 illegal lot owners must submit a new subdivision application (along with the fee) and go through a "waiver" process, as well as follow the regular steps that one must take when trying to establish a legal subdivision. Is the Code Enforcement Officer just "making it up as he goes along", or is there something out there that guides him to ask us to do it this way?
